Terms and Conditions of Sale

Definitions

• "T&Cs" means these terms and conditions of sale, setting out how the Site may be used and the conditions under which Orders are placed;
• "Customer" means any natural or legal person, with or without a valid account, placing one or more Orders;
• "Order(s)" means the firm order or orders placed by the Customer for the purchase of one or more Products available on the Site;
• "Account" means a User's valid account allowing Orders to be placed;
• "Content" means the content (text, sound, video) published on the Site by THE BEAUTY PLANT FACTORY and belonging to it;
• "Personal data" means any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity;
• "Privacy policy" means the document drawn up by THE BEAUTY PLANT FACTORY setting out the processing of Users' Personal data and defining their corresponding rights [link to be inserted];
• "Product(s)" means the cosmetic items, food supplements, accessories and BeautyFood, and more generally the products offered for sale by Nature AZ Laboratory through the Site www.thebeautyplantfactory.com;
• "Site" means The Beauty Plant Factory online shop, accessible from any device (including mobile and tablet) at www.thebeautyplantfactory.com, where Users can place an Order;
• "User" means any person, whether a Customer or not, who visits or browses the Site.

The site www.thebeautyplantfactory.com is published by Nature AZ Laboratory, located at Recoules-d'Aubrac 48260 (France) and represented by its co-manager Frédérique Letzelter. The T&Cs are accepted by Customers when placing an Order and can be consulted by Users at any time from the Site. By accessing the Site, Users acknowledge that they have read and understood the T&Cs and agree to be bound by them. Nature AZ Laboratory reserves the right, at its sole discretion, to amend the T&Cs at any time; the applicable T&Cs are those accepted by the Customer at the time of the Order.

Nature AZ Laboratory owns the trademarks THE BEAUTY PLANT FACTORY, MALEBIAU, OAT POWER, NATURE AZ, registered and filed with the INPI (the French industrial property office).

3. Placing Orders from the Site

Orders are placed from the Site.

3.1. Creating an Account

To place an Order, the User may create an Account by choosing a password. If an Account is created, the User will receive an email from THE BEAUTY PLANT FACTORY confirming their registration. They must then sign in using their password.

Users' passwords are strictly personal and confidential. The Beauty Plant Factory/Nature AZ Laboratory recommends that Users change their passwords regularly and choose complex passwords including letters, numbers and special characters. Users must not share them with anyone else.

Users are responsible for the loss or theft of their password if it is proven that they committed a fault attributable to them. In that case, Users must inform The Beauty Plant Factory/Nature AZ Laboratory without delay.

For more information on the processing of Personal data by Nature AZ Laboratory, the User is invited to consult the Privacy policy.

3.2. Selecting Products and adding them to the Customer's basket

The User may select the Products of their choice, provided they are available for online sale in the desired quantity. The total price, inclusive of all taxes, together with the amount of those taxes, will be shown on the Site. To add a Product to the basket, the User must:

• choose the Product and the desired quantity;
• click the "add to basket" button.

Each new addition to the basket will be shown on the Site by the number of items displayed in the basket. At any time the User may view a summary of the Products selected in their basket, carry on browsing the Site, or complete the Order by proceeding to payment.

3.3. Payment to complete the Order

Before completing the Order and proceeding to payment, the User is taken to a page of the Site allowing them to review the details of the selected Products, which they may amend. Before proceeding to payment, the User must enter their billing and delivery details and choose a shipping method. They must check their Order carefully, confirm the billing and delivery details, and accept the T&Cs.

Payment for the Products may be made by any payment method offered on the Site, in particular by bank card (including MasterCard, Visa and American Express) and through the Stripe, Bancontact or Blik platforms. Payment by cheque is accepted, but the order will only be dispatched once the cheque has been received and cleared. The Order will only be processed by The Beauty Plant Factory once payment has been made by the Customer.

3.4. Confirmation of the Order by The Beauty Plant Factory

After placing the Order, the Customer can access from their Account a summary of the Order on the Site, showing in particular the order number. This summary will be sent to the Customer in a confirmation email setting out all the elements of the contract of sale concluded between the Parties. This information constitutes proof of the nature, content and date of the Order placed by the Customer and is deemed accurate, which the Customer expressly accepts.

3.5. Delivery of the Products to the address provided by the Customer

The Products will be delivered to the address the Customer entered when placing the Order.

4. Purchase conditions & Customer warranties

To place an Order, the Customer, if a natural person, must be of full age (or, if a minor, be over sixteen and place the Order with their legal representatives) and legally capable of contracting. If the Order is placed on behalf of a legal person, the Customer declares and warrants that they are authorised to place the Order on its behalf. In that case, the Customer undertakes to buy the Products for personal use and not for resale to third parties.

The Customer warrants that the Products will not be delivered, sold or distributed for commercial purposes. Any Order placed in breach of this article will be null and void. By confirming an Order, the Customer submits to The Beauty Plant Factory/Nature AZ Laboratory an offer to purchase the Products placed in their basket. The Beauty Plant Factory/Nature AZ Laboratory reserves the right to refuse, cancel or terminate any Order at any time where circumstances justify it, in particular in the event of a breach of the T&Cs or an attempted fraud.

5. Product information & availability of the Products offered on the Site

The Products offered for sale are those shown on the Site and available to order, except in the event of exceptional unavailability, withdrawal of the reference or product, restocking, or manufacture in progress by The Beauty Plant Factory/Nature AZ Laboratory.

Sales offers, including promotional offers, are valid for as long as they are announced on the Site. The Beauty Plant Factory/Nature AZ Laboratory makes every effort to comply with the requirements of article L.111-1 of the French Consumer Code by publishing the essential characteristics of the Products.

Photographs of the Products are provided for illustration and are not contractual. The User is invited to consult the description of each Product for its essential characteristics. In the event of exceptional unavailability of the Product ordered, The Beauty Plant Factory/Nature AZ Laboratory will inform the Customer as soon as possible and the Customer may change their choice or cancel the Order.

7. Price of the Products & shipping costs

The prices of the Products are firm. They are invoiced on the basis of the rate in force at the time the Order is confirmed. Prices are expressed in euros, net, inclusive of all taxes. The price of the product is its price including tax, excluding delivery costs.

Exceptional packaging and shipping costs will be communicated to the Customer before the Order is confirmed. For mainland France, Belgium, Monaco, Andorra and Luxembourg, delivery is free from €49 of purchases. For any order between €1 and €49, a flat delivery charge of €6 applies. For other countries, prices are adjusted according to the delivery zone.

Under no circumstances do the prices shown on the Site at the time of the Order bind The Beauty Plant Factory/Nature AZ Laboratory for future orders. The Beauty Plant Factory/Nature AZ Laboratory may change the prices of the Products at any time, without notice, except for Orders in progress.

8. Payment for the products & invoicing

The Customer must pay for their Order in full by bank card through technical providers such as Stripe, Bancontact or Blik, or by any other method offered by The Beauty Plant Factory/Nature AZ Laboratory. To make payment, the Customer will enter their payment details with the technical provider responsible for processing online payments. Bank card transactions are secure.

If payment authorisation is refused, The Beauty Plant Factory/Nature AZ Laboratory will suspend the Order and any delivery. The Customer must then contact the card issuer directly to resolve the problem.

The products ordered remain the property of The Beauty Plant Factory/Nature AZ Laboratory until their price has been paid in full. In the event of a payment incident, the Customer undertakes to return the Products received immediately on first request from The Beauty Plant Factory/Nature AZ Laboratory.

From the effective date of delivery, the risks (including loss, theft or damage) relating to the Products delivered are borne entirely by the Customer. All invoices are dated the day the Order is placed and sent to the Customer by email.

9. Dispatch and delivery of the Order

The Products will be delivered to the delivery address provided by the Customer when placing the Order.

Unless stated otherwise on the Site, The Beauty Plant Factory/Nature AZ Laboratory can ship the Products within mainland France (including Corsica and the overseas territories) and to certain European Union countries, at the rates and within the times set out on the Site.

The Order is confirmed once payment has been accepted by The Beauty Plant Factory/Nature AZ Laboratory. The Beauty Plant Factory/Nature AZ Laboratory reserves the right to refuse an Order if the Customer has an ongoing dispute with the company or is considered a non-payment risk. In that case, additional information may be requested from the Customer (identity document, proof of address). Without a reply within 5 days, the Order and the payment will be cancelled.

The Beauty Plant Factory/Nature AZ Laboratory undertakes to fulfil Orders received within the limits of available stock.

Dispatch times:

• Any order placed between Monday and Thursday before 11pm will be dispatched the following day.
• Any order placed from Friday after 9am until Sunday evening will be dispatched the following Monday.
• Any order placed on a public holiday will be dispatched the next working day.

In mainland France, standard parcels are delivered by Colissimo within 2 to 3 working days of dispatch. Delivery generally takes place between 2 and 7 days after the order is confirmed, and within 30 days at the latest.

Delivery times are the sole responsibility of the carriers. Under no circumstances can The Beauty Plant Factory/Nature AZ Laboratory be held liable for a delay.

Because of the geographical location of the order preparation site (in a mountain area), The Beauty Plant Factory/Nature AZ Laboratory cannot be held liable for delays linked to bad weather (such as snow) or technical incidents (internet or telephone outage).

Outside the European Union, customs or import duties may be added to the price of the Products and remain payable by the Customer.

Delivery is deemed to have taken place when the Order is received by the Customer or the designated recipient. The Customer must check the condition of the Products and report any damage to The Beauty Plant Factory/Nature AZ Laboratory immediately. No claim will be accepted if the parcel is marked as delivered, the proof being the carrier's computer system or the acknowledgement of receipt.

In the event of late or failed delivery, The Beauty Plant Factory/Nature AZ Laboratory cannot be held liable where this is due to a fault of the Customer, to an unforeseeable and insurmountable third party, or to a case of force majeure (article L.121-19-4 of the French Consumer Code).

10. Customs charges

Customs charges may apply to Orders placed outside the European Union. These additional charges are not included in the total price of the Order and are payable entirely by the Customer. It is for the Customer to find out about these charges from their local customs authorities and to pay them.

11. Return costs not refunded

If a parcel is held by customs and refused by the Customer, the return costs are payable solely by the Customer.

12. Instructions for returning Products

A return is only possible if the product has not been opened or consumed. Return costs are payable by the Customer.

The returned product must be intact, in its original packaging, accompanied by the order number, the details of the items returned and a request for an exchange or a credit note.

We recommend choosing a tracked shipping method. Without a tracking number, no claim will be accepted.

Before any return, an email must be sent to [email protected]

If the return is refused, the product will be sent back to the Customer at the expense of The Beauty Plant Factory/Nature AZ Laboratory, with no possibility of compensation. If the Customer has not notified their return, a credit note will be generated automatically.

13. Right of withdrawal

In accordance with the French "loi Hamon", the Customer has a withdrawal period of 14 days from receipt of the product.

To exercise this right, an email must be sent to [email protected] with the subject "Right of withdrawal + order number".

The Customer must return the Products within 14 days, the return costs being payable by the Customer. The Beauty Plant Factory/Nature AZ Laboratory will refund all payments, including standard delivery costs, within 14 days of receiving the returned Products or proof of dispatch.

14. Non-conforming products and hidden defects

In the event of a defective product, the Customer may request a replacement or cancellation of the sale. The Beauty Plant Factory/Nature AZ Laboratory will bear the return costs.

15. Liability and warranties

The Beauty Plant Factory/Nature AZ Laboratory cannot be held liable for:

• a stock shortage arising after the Order;
• a delay or failure to perform due to an unforeseeable and irresistible event;
• technical or hosting problems affecting the Site.

Should the liability of The Beauty Plant Factory/Nature AZ Laboratory be engaged, it may not exceed the total amount of the Order.

17. Intellectual property

The Site is protected by intellectual property law and is the exclusive property of Nature AZ Laboratory. Any reproduction, even partial, is prohibited.

18. Producer responsibility, unique identifier

As a company placing packaged products on the market under the French Extended Producer Responsibility (EPR) scheme for household packaging and graphic paper, Nature AZ Laboratory holds a unique identifier (IDU). This attests to its registration with an approved eco-organisation. IDU FR334896_01XXMQ
